1. Website Plans
The Foundation ($199.00 per month): This plan includes a custom designed website consisting of up to five (5) pages, typically Home, Capabilities, About Us, Services, and Contact. All layout copy is written by the Company. If Client does not provide images, compliant stock photography will be used. This plan includes secure cloud hosting, an SSL certificate, and assistance connecting an existing domain. Each billing cycle includes up to sixty (60) minutes of routine content maintenance, limited to text updates, image replacement, or styling adjustments on existing pages.
The Growth Engine ($299.00 per month): This plan includes all deliverables of The Foundation, plus on-page search engine optimization targeting up to ten (10) local keywords, one lead capture form or quote estimator, one automated email sequence consisting of a welcome message and up to two follow-up messages, and integration of the lead form with one CRM account. This plan also includes one Database Reactivation Campaign, in which the Company contacts up to five hundred (500) existing contacts provided by Client via email and SMS to generate reviews, bookings, or inquiries. This campaign is subject to the requirements set forth in Section 8.
2. Google Business Profile and Logo Add-Ons
Setup of a Google Business Profile is available as a one-time fee of $400.00 and includes claiming or creating the listing, verification support, category and description optimization, business hours, photo upload, and a direct review link. Ongoing monthly management is $100.00 and includes up to two (2) posts per month, review monitoring, and a monthly performance report.
A custom logo is available as a one-time fee of $200.00 and includes one logo design, two initial concepts, and up to two rounds of minor revisions. Final files are delivered in vector and transparent PNG formats.
3. Term and Billing
All plans require a minimum twelve (12) month commitment beginning on the date of checkout. The first and last months are billed at checkout. Billing for the intervening months begins thirty (30) days after checkout and continues on a monthly basis.
- The Foundation: $398.00 due at checkout, then $199.00 per month. With Google Business Profile: $898.00 at checkout, then $299.00 per month.
- The Growth Engine: $598.00 due at checkout, then $299.00 per month. With Google Business Profile: $1,098.00 at checkout, then $399.00 per month.
- Logo Add-On: The logo add-on adds a flat, non-refundable $200.00 to the checkout total.
4. Setup Fee Waiver and Early Termination
A standard setup fee of $1,995.00 is waived provided Client completes the full twelve (12) month term. If Client cancels, terminates service, or requests migration of website files prior to completion of the twelve (12) month term, a buyout fee of $1,995.00 is due. Website files, data, and domain settings will not be released or transferred until this fee is paid in full.
5. Services Outside of Plan Scope
Work requested outside the deliverables listed in this Agreement is billed separately at a rate of $150.00 per hour, in thirty (30) minute increments, with a one (1) hour minimum per request. This includes, without limitation, a sixth page, on-page SEO or CRM configuration on The Foundation plan, maintenance exceeding the monthly allotment, or additional Google Business Profile activity. An estimate will be provided prior to any such work, and no charges will be applied without Client authorization.
6. Onboarding
Client has fourteen (14) business days from checkout to provide business information, access credentials, and content. This deadline does not affect or delay billing. If materials are not received within this period, the Company will build and deploy the site using standard placeholder content, and the project will be considered complete. Requests to replace placeholder content after this period will be billed as out-of-scope work at the standard hourly rate.
7. Ownership
The Company retains ownership of all underlying code, plugin structures, and technical systems used to operate the website. Full ownership rights to custom graphics, layout, and pages are transferred to Client upon completion of the twelve (12) month term or payment of the buyout fee.
8. Client Provided Contact Data
Where the Database Reactivation Campaign is included in Client’s plan, Client represents that all contacts on any list provided have consented to being contacted and that the list was not purchased, scraped, or otherwise obtained without consent. SMS communication is subject to the Telephone Consumer Protection Act (TCPA). Client is responsible for maintaining proper consent records prior to submission of any contact list. The Company will suppress future messages to any contact that replies “STOP.” Client agrees to indemnify the Company against any claim, fine, or penalty arising from the contact list provided. Contact data is retained only for the duration necessary to complete the campaign and is not resold or reused.
9. Acceptable Use
The Company reserves the right to suspend or terminate service if Client’s business or website content involves illegal activity, fraud, adult content, or violation of the policies of third-party platforms used in service delivery, including hosting providers and Google. Client is solely responsible for the accuracy and legality of all content, claims, and credentials published to the website. Termination under this section does not relieve Client of remaining financial obligations under the term or buyout provisions of this Agreement.
10. Subcontracted Work
Portions of the design, development, or marketing work may be performed by third-party contractors engaged by the Company. The Company remains the sole point of contact and retains full responsibility for all deliverables under this Agreement.
11. Payment and Suspension of Service
Client must maintain a valid payment method on file for the duration of service. In the event of a failed payment, Client has five (5) business days to resolve the issue before further action is taken. If an invoice remains unpaid for seven (7) calendar days, the Company will suspend hosting and related services, including Google Business Profile posting, forms, and CRM integration. Reinstatement requires payment of a $100.00 reactivation fee in addition to any past due balance. Suspension does not waive or reduce Client’s obligations under the twelve (12) month term.
12. Refunds
All upfront payments, including subscription fees, Google Business Profile setup, and logo design, are final and non-refundable once checkout is complete and work has commenced, except as required by applicable law. Monthly payments are non-refundable and non-prorated in the event of mid-cycle cancellation or non-use. Billing disputes should be directed to the Company prior to initiating a chargeback. A chargeback for services already rendered does not waive Client’s obligations under this Agreement, and the Company reserves the right to pursue collection of disputed amounts along with any associated processor fees.
13. Renewal and Post-Term Pricing
Upon completion of the twelve (12) month term, service converts to an open-ended, month-to-month arrangement at Client’s existing rate. Client may cancel at any time during this period with thirty (30) days written notice by email. The Company may adjust pricing during the month-to-month period with a minimum of thirty (30) days advance written notice. Continued use of service following such notice constitutes acceptance of the revised rate.
14. Force Majeure
The Company is not liable for delays or service interruptions resulting from causes beyond its reasonable control, including natural disasters, labor disputes, internet infrastructure failures, or outages and policy changes originating from third-party providers, including hosting companies, domain registrars, Google, email providers, or SMS carriers. Service will resume as soon as reasonably practicable, and such delays do not extend the term or entitle Client to a refund or credit.
15. Limitation of Liability
Hosting, Google Business Profile management, and automation tools are provided on an "as-is" basis, without guarantee of uptime, performance, or search ranking outcomes. The Company is not liable for lost revenue, missed business opportunities, or issues arising from third-party software. Client assumes full responsibility for the accuracy and legality of all content published to the website.
16. Governing Law and Dispute Resolution
This Agreement is governed by the laws of the State of Florida. In the event of a dispute, the parties agree to attempt good faith resolution for a period of thirty (30) days prior to initiating formal proceedings. Disputes not resolved through negotiation will be settled by binding arbitration under the rules of the American Arbitration Association. Each party is responsible for its own costs unless otherwise determined by the arbitrator. Disputes will be resolved on an individual basis, and no class, collective, or representative action may be brought against the Company.
